1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the MaxMyPerk website, application, and related services (collectively, the “Service”) operated by GZM Tech LLC (“we,” “us,” or “our”), a Missouri limited liability company. By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not use the Service.

2. Description of the Service

MaxMyPerk is a web-based tool that helps you track credit card benefits—such as statement credits, perks, and free night certificates—and receive reminders (e.g., by email or push notification). The Service is provided for personal, non-commercial use. We do not provide financial, tax, investment, or legal advice. Benefit information in the Service is for general informational purposes only; you are solely responsible for verifying benefit terms, eligibility, and deadlines with your card issuer or program.

3. Account Registration and Security

You must provide accurate and complete information when registering and keep your account credentials secure. You are responsible for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. You may not share your account with others or use the Service for any illegal or unauthorized purpose.

4. Acceptable Use

You agree to use the Service only in compliance with these Terms and applicable laws. You may not: (a) use the Service in any way that could damage, disable, or impair the Service or our systems; (b) attempt to gain unauthorized access to the Service, other accounts, or our networks; (c) reverse engineer, decompile, or attempt to extract source code from the Service (except as permitted by applicable law); (d) use automated means (e.g., bots, scrapers) to access the Service without our permission; or (e) use the Service to transmit malware or illegal content.

5. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal use in accordance with these Terms. You do not acquire any ownership rights in the Service.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT BENEFIT INFORMATION IS ACCURATE, COMPLETE, OR CURRENT. YOU USE THE SERVICE AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GZM TECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless GZM Tech LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights or applicable law.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. We may retain and use your data as described in our Privacy Policy and as required by law.

10. Changes to the Terms

We may modify these Terms at any time. We will post the revised Terms on this page and update the “Last updated” date. For material changes, we may provide additional notice (e.g., by email or in the app). Your continued use of the Service after the effective date of the changes constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service.

11. General Provisions

Governing law. These Terms shall be governed by the laws of the United States and the State of Missouri, without regard to conflict of law principles.

Disputes. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Missouri, and you consent to personal jurisdiction there.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and GZM Tech LLC regarding the Service and supersede any prior agreements.
